TERMS & CONDITIONS:

RENTAL AGREEMENT / (Form #A0827)

This agreement is a contract between the Renter and KE Dancewear (Owner).  Upon making a purchase, the Renter agrees to the terms and conditions indicated below in the Rental Agreement for the renting of performance dance garment(s).  This contract allows the rental of no more than three garment(s).

1.     Rental and Try-on Fees:  The Renter may pay via check, money order or credit card a Rental fee in advance of any garment selected.    This fee must be paid at least ten days prior to the event shipment of garment(s).

Payment via Check or Money Order:

a.     If paid by check, it is required that a check for the Rental fee and the estimated shipping cost be sent to the Owner.  Note: Checks must be received and cleared by bank prior to confirmed reservations and/or shipments.

b.     A Security hold in the amount of the full value of the garment must be placed on a credit card of the Renter and will be released when the garment is returned to the Owner.  A deposit check will not be acceptable.

Payment via Credit Card:

a.     The Renter’s credit card will be charged the Rental fee and the estimated shipping cost by the Owner.

b.     A Security hold in the amount of the full value of the garment will be placed on the credit card of the Renter and will be released when the garment is returned to the Owner.

2.     Deposits are required to reserve rental garment(s).  Deposits are $65 and non-refundable.

3.     The Renter is responsible for all shipping and handling charges related to the return of the garment(s) to Owner.

4.     All shipments of rental garment(s) must be signed as proof of receipt of merchandize.

5.     Failure to return rental garment(s) by the agreed upon date will result in a late fee of $50 per day for ten days, after which time the full value of the garment(s) will be charged to the Renter.  Return Shipments must be postmarked no later than the last day of the agreed rental date.

6.     Form #A0827 must be completed by Renter or on file yearly with KE Dancewear before any garment(s) can be shipped for Try-On or Rental.

7.     Try-On Garment(s) must be returned in the same condition received including all tags & still clean prior to the date of any performance to avoid additional Full Rental and/or Full Value charges.

8.     Rental Garment(s) must be returned in the same condition received excluding hangtags & still clean to avoid additional Full Rental and/or Full Value charges.  Renter will be responsible for any damages occurring due to alterations. DO NOT ALTER ANY DRESS YOU ARE RENTING.

9.     Any damages, stains, or excessive lost of crystals will result in additional charges and/or full value of the garment(s) charges to the Renter.  Assessment of damages will be at the discretion of owner.

10.  Any damage as a result of any tanning products used by the Renter that may cause discoloration of the garment(s) will result in paying the full value of the garment(s).

11.  Renter agrees NOT to take garment(s) for dry cleaning as such harsh chemicals involved may result in irreversible damages.  DO NOT DRY CLEAN FOR ANY REASON.

12.  The Renter is responsible for the safe care and return of the garment(s).  The Renter bears the entire risk of loss, stolen or missing garment(s) and will result in paying the full value of the garment(s).

13.  The Renter will be charged $25.00 for any returned check.  This amount will be charged each time the check is processed and accepted by the banking institution that it is written on.

14.  In the event that the credit card is invalid or declined, the Owner reserves the right to charge a $10 processing fee for each occurrence.

15.  Refund Liability Waiver: Owner cannot be held liable for improper fit of garment(s), wardrobe malfunctions for any reason whatsoever and exculpates and indemnifies KE dancewear and all officers and agents from losses, injuries, claims, and expenses arising out of the rental and use and additionally agrees that the garment(s) are rented “as is”.

16.  Cancellations less than 21 days prior to ship dates, will NOT receive a refund of any and all deposits.  Cancellations less than 10 days will be charged the full rental fee.

17.  Rental garment(s) are the exclusive property of Owner and the Renter shall have no rights other than the rental terms of this agreement.

18.  Reasonable attorney fees and court cost incurred in the collection of any amount due to the Owner is the sole responsibility of the Renter.

CONSIGNMENT AGREEMENT/ (Form #A0112)

THE KE DANCEWEAR GUARENTEE:

KE Dancewear is committed to helping performers find the perfect ballroom dress for a fraction of the cost.  Garments under our consignment must receive the same care and attention as our KE custom design rental collection.  All garments must be clean and in good condition for renting.

HOW KE DANCEWEAR CONSIGNMENT WORKS . . .

1.     SUBMIT CONSIGNMENT SUBMISSION FORM:  Consignee must fill out the form providing a detailed description of the dress and a digital picture of the dress in motion being worn during a performance via showcases and/or competition (Step-&-Repeat still photos are acceptable as well).  Your best chance for approval are professional pics.

2.     WAIT FOR SUBMISSION APPROVAL:  Consignee pictures and submission form will be reviewed for approval.  KE dancewear will evaluate if the dress will fit well within our inventory.

3.     ONCE APPROVED:  You’ll be notified if your consignee submission is approved.  We will then add a picture of your dress on our site for rental and or for sale.  You will then be responsible for storing the garment clean, bagged, and ready to ship to customers.   Consignee’s are responsible for shipping rentals to clients and must ship in a timely manner as requested. (Shipping fees are covered by KE dancewear clients and will be returned to the consignee.)

4.     ONCE IT SHIPS TO A CUSTOMER:  Customers have the option to return the garment if it does not properly fit.  Note that in any case that a customer is not pleased with the product, the product will be returned and a full refund will be given; any consignee revenue will be voided.

5.     IF MY DRESS IS RENTED AND OR SOLD: All rentals will be split 50/50 between consignee and KE dancewear.  If the dress is sold, we keep 30% and you get 70%.  A credit card must remain on file with KE dancewear to cover the $25 processing fee if the garment is sold.

6.     IF I WANT MY DRESS BACK:  As the owner of the dress, you can request that your dress be removed form our inventory at any time.  (Written notice must be sent via email to rent@kedancewear.com)

7.     WHEN DO I GET PAID:  Consignee payments are issued at the end of each month and can take 7-10 day s to arrive.  If your dress is rented and/or sold, you will receive an email notifying you of the financial exchange.

NOTE: 
By submitting your dress onto our inventory, we require a release for lost, stolen, damaged, or accidents as we cannot be held responsible.  We host your gown in our inventory collection and take a credit card on file for any customer renting and or purchasing your garment as insurance.  Click Here for Consignment Submission form

 

TRY-ON AGREEMENT/ (Form #KETOA-0229)

Upon submitting a Try-on request, the customer agrees to the terms and conditions indicated below for the Try-on Agreement for rental of performance dance garment(s).

1.   The Renter may pay via check, money order or credit card a non-refundable Try-On fee of $25.00 per garment in advance of any garment selected. This fee is not refundable. Try-On fees do not apply to cost of rental. This fee must be paid at least three days prior to the shipment of garment(s).

Payment via Check or Money Order:

a.  If paid by check, it is required that a check for the Try-On fee and the estimated shipping cost be sent to the Owner.
b.   A deposit check must also be sent to the Owner for the full value of the garment, which will be held until the garment is returned to the Owner.(This fee may be waived by owner)

Payment via Credit Card:

a.  The Renter’s credit card will be charged the Try-On fee to cover general packing and shipping cost.  / shipping cost over $25 will be charged to customer.
b.  A credit card HOLD for the 50% value of the garment is placed on the credit card when rental garment(s) are shipped and will be released when the garment is returned in the same condition it was shipped.  (This fee may be waived by owner)

2.  The Renter is responsible for all shipping and handling charges related to both shipment to Renter and the return of the garment(s) to Owner.
3.  Any shipment of rental garment(s) must be signed as proof of receipt of merchandize.

7.  Any damages or excessive loss of crystals will result in additional charges to the Renter.
8.  Any damage as a result of any tanning products used by the Renter that may cause discoloration of the garment(s) will result in paying the full value of the garment(s).
9.  The Renter is responsible for the safe care and return of the garment(s). The Renter bears the entire risk of loss, stolen or missing garment(s) and will result in paying the full value of the garment(s).
